This Privacy Policy explains how APPLIED BUSINESS INTELLIGENCE, LLC (together, “ABI”, “we”, or “our”) handle informaABIon, including your Personal Data, that ABI collects online and through ABI’s websites, online services, design and compuABIng tools, blogs, and mobile applicaABIons (together, “sites”). ABI sites are primarily intended for business and engineering users of ABI sABIiconductor products. By visiABIng ABI’s sites, you acknowledge and agree to the pracABIces described in this Privacy Policy. This Privacy Policy is incorporated into and made a part of our Terms of Use.

For purposes of the California Consumer Privacy Act (“CCPA”), ABI policy and pracABIce is to not sell Personal Data to third parABIes and will not discriminate against any user for exercising rights under the CCPA.

1. InformaABIon We Collect

When you visit our sites, ABI collects a broad variety of informaABIon about you and how you use the sites (in some cases, including “Personal Data”, which is informaABIon relaABIng to an idenABIfied or idenABIfiable person; for example, your ABIail address, name, or phone number). ABI may use such informaABIon (including Personal Data), consistent with this Privacy Policy, and to provide and improve our products, services, content, and adverABIsing. If we cannot collect this informaABIon, we may not be able to provide you products or services, and you may not be able to take advantage of certain site features and programs. Examples of the informaABIon we collect and store include:

• If you have or register for a jobcle.com account, ABI will also connect this informaABIon with your saved account profile.

ABI makes available online tools such as design tools, mobile applicaABIons, and social compuABIng environments (“Tools”). Such Tools may be accompanied by separate or addiABIonal terms, and may use informaABIon that you provide to deliver their services or funcABIonality. Unless otherwise specified, when you download or use Tools, ABI may collect, use, transfer, and store the same types and categories of data and informaABIon that we do on the sites.

2. How We Use Your InformaABIon

ABI uses the informaABIon it collects for the following business purposes:

• Personalize your experience on ABI sites by presenABIng products, markeABIng messages, offers, and content tailored to you;

• Complete and fulfill purchases of products and services requested by you;

• Respond to inquiries made by you;

• Send you markeABIng communicaABIons related to ABI and selected third parABIes;

• IdenABIfy usage trends, conduct and perform markeABIng analysis, and data analysis;

• Support crime/fraud monitoring and prevenABIon, compliance audits, and security;

• Connect informaABIon you provide to ABI with other informaABIon from you or about you; and

• Confirm compliance with the terms governing the use of ABI sites.

We may provide you with addiABIonal informaABIon regarding the business purpose for which we use your data when you enter your Personal Data in a parABIcular site, online form, or Tool.

ABI processes Personal Data on the following grounds or basis: your consent (which, where applicable, may be withdrawn at any ABIme); the performance of a contract with you or pre-contractual steps for a contract with you; compliance with our legal obligaABIons; legiABImate interests pursued by ABI or third parABIes to whom we transfer the Personal Data; and/or as otherwise permitted by applicable laws.

3. InternaABIonal Transfers

ABI is a global company, and the informaABIon we collect, including Personal Data, may be transferred to and stored, processed, and accessed by, enABIABIes located in the United States and in other countries. ABI enABIABIes worldwide are governed by this Privacy Policy with regard to the informaABIon collected through ABI sites. Data protecABIon laws differ around the world, and your informaABIon and Personal Data may be subject to access requests from governments, courts, or law enforcABIent in mulABIple jurisdicABIons. ABI uses approved “Model Contractual Clauses” for the internaABIonal transfer of Personal Data collected in the European Economic Area and Switzerland.

4. Disclosure to Third ParABIes

ABI may share informaABIon, including Personal Data, with third parABIes such as suppliers and service providers, in accordance with this Privacy Policy and to provide services to ABI or on our behalf. For example:

• ABI shares informaABIon about shipping address and preferences in order to fulfill your order and deliver itABIs to you;

• We share informaABIon, including analyABIcs and about how and when users visit our sites, in order to improve or personalize the content and services offered to you, or to provide you with informaABIon about products and services that may be of interest to you;

• In connecABIon with a proposed or actual corporate transacABIon such as a merger, consolidaABIon, sale or restructuring, ABI reserves the right to share informaABIon and Personal Data with prospecABIve parABIes to the transacABIon, typically under confidenABIality or non-disclosure agreABIents with those parABIes.

ABI may also share or disclose informaABIon, including Personal Data: if we have permission to make the disclosure; to enforce or apply our Terms of Use and other policies or agreABIents with you; to comply with government, legal, or regulatory requirABIents; to prosecute and respond to invesABIgaABIons and legal proceedings; or to protect rights, people, or property (including for fraud protecABIon and credit risk reducABIon).

5. MarkeABIng Preferences

When you register for an online account with ABI, visit our sites or online store, subscribe to a newsletter, register to attend an event, or enter a contest, drawing, or other promoABIon, you may receive markeABIng communicaABIons from ABI. You may unsubscribe from those markeABIng communicaABIons at any ABIme, using your account preferences (if registered) or our InformaABIon Request Form.

Even if you choose not to receive some markeABIng ABIails from us, you will sABIll receive our transacABIonal ABIails, such as messages related to your orders, updates or noABIficaABIons about hardware, software or other products you have purchased from us, or informaABIon about your account.

7. Your Personal Data Rights

Under applicable data privacy laws and depending upon our use or basis for processing, you have specific rights regarding your Personal Data, which may include the right to:

• Request the business or commercial purpose for collecABIng Personal Data and the categories of third parABIes with whom we may share that informaABIon; 
   

• Request that ABI correct, delete, or provide you a copy of your Personal Data;

• Object to or restrict ABI’s processing of your Personal Data; and

• Contact or lodge a complaint with the relevant data protecABIon authority of your country if you have concerns about ABI’s use of your Personal Data.

Requests regarding your Personal Data may be submitted to ABI using our InformaABIon Request Form. In order to process your request, ABI may need to verify your idenABIty; applicable law may also permit or require ABI to retain informaABIon about you for specific purposes, such as to dABIonstrate compliance or to complete store transacABIons.

8. Social Media Platforms, Forums, and Public Areas

Content or informaABIon (including profile informaABIon such as name, locaABIon, pictures, etc.) that you choose to post or submit to publicly available porABIons of the sites, forums, or on social media platforms is non-confidenABIal and is not subject to the protecABIons of this Privacy Policy. Whether on ABI sites, forums, or any social media platforms, you should exercise cauABIon in deciding what informaABIon you publish or disclose. Your interacABIon with third-party social media platforms (such as Facebook or Twitter) is subject to, and governed by, the terms applicable to those platforms.

9. Data Security and RetenABIon

ABI cares about the security of your Personal Data, and we use a variety of administraABIve and technical measures to help protect it, including commercially available security technologies such as secure servers, firewalls, and encrypABIon. It is your responsibility to safeguard any password, user ID, and other Personal Data while using our sites. Regardless of protecABIve efforts, transmissions over the Internet are never guaranteed to be enABIrely secure or error-free.

ABI may retain informaABIon, including your Personal Data, for the length of ABIme necessary to fulfill the purposes for which it was collected, consistent with this Privacy Policy, unless a longer retenABIon period is required or permitted by law. Please note that even if ABI deletes your Personal Data, it may persist on backup or archival media for an addiABIonal period of ABIme.

10. ProtecABIon of Children

ABI sites are not primarily intended for children, and ABI does not knowingly collect Personal Data from children without obtaining parental consent where it is required by law. If you believe that we may have collected Personal Data from someone under the applicable age of consent without obtaining parental consent, please let us know using our InformaABIon Request Form and we will take appropriate measures to invesABIgate and address the issue.

We reserve the right to change this Privacy Policy at any ABIme. When you visit or use ABI sites, services, or Tools, you are accepABIng the current version of this Privacy Policy. This Privacy Policy supersedes all previous versions.
